End User License Agreement

ICONSTELLATION END USER LICENSE AGREEMENT Version 1.0-DRAFT — REQUIRES REVIEW BY A QUALIFIED LAWYER BEFORE ANY PUBLIC RELEASE This End User License Agreement ("Agreement") is between you and the publisher of Iconstellation ("we", "us") and governs your use of the Iconstellation desktop application (the "Software"). 1. LICENSE GRANT We grant you a personal, non-exclusive, non-transferable license to install and use the Software on devices you own or control, for personal or internal business use, subject to this Agreement. 2. WHAT THE SOFTWARE DOES The Software rearranges the position of icons on your Windows desktop and can change desktop view settings (such as icon alignment options) to do so. Before the first change it makes, the Software saves a snapshot of your original icon layout and keeps it so you can restore it at any time ("Original layout"). The Software modifies only icon positions and related view settings; it does not delete, move, or modify your files. 3. YOUR CONTENT Shapes you create with the Software belong to you. We claim no ownership of your creations. 4. RESTRICTIONS You may not sell, rent, sublicense, or redistribute the Software; reverse engineer it except where the law permits; or use it to build a competing product from its code. 5. PRIVACY The Software makes no network connections and transmits no data in this version. All settings, layout snapshots, created shapes, and crash reports are stored locally on your device (see the accompanying Privacy Statement). 6. NO WARRANTY THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT IT WILL BE ERROR-FREE OR UNINTERRUPTED. YOUR SOLE REMEDY FOR DISSATISFACTION IS TO STOP USING THE SOFTWARE. 7. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF THE SOFTWARE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE. 8. THIRD-PARTY COMPONENTS The Software includes third-party components distributed under their own licenses; see the Third-Party Notices file included with the installation. 9. TERMINATION This Agreement terminates automatically if you breach it. Upon termination you must uninstall the Software. Sections 6-7 survive termination. 10.
